The Supreme Court of Pakistan is the highest court in the judicial hierarchy of the Islamic Republic of Pakistan. Its main purpose is to determine the rights of citizens and protect their interests. Malik’s career
Judge Amin Malik’s elevation to the Supreme Court of Pakistan sparked widespread controversy. She is the first woman to be appointed to the court in its 74-year history. Lawyers accused the commission of disregarding seniority rules and putting Malik ahead of senior male judges. Many lawyers threatened to go on strike if she were appointed.
Justice Malik was previously a judge in the Lahore High Court. She will continue to serve as a judge in the Supreme Court until June 2031. She will then become the senior most judge of the Supreme Court, likely becoming the first woman Chief Justice of Pakistan.
Malik’s judicial career has been marked by numerous landmark verdicts. One of the most notable was her decision outlawing the practice of performing virginity tests on female rape survivors. This practice cast suspicion on the victim and is only applied in the province of Punjab. The judgment was so influential that the Sindh and Punjab governments had to issue orders banning the practice. It became a precedent for all Pakistan’s high courts.
Malik has also worked as a pro bono lawyer for NGOs and has served on the Lahore High Court as a judge. Malik’s work has largely been praised by lawyers and activists, but it has also drawn criticism from some. Malik has served as a high court judge in Lahore for over 20 years and has challenged patriarchal legal practices in the province. Her recent appointment to the Supreme Court of Pakistan has caused a backlash.
Justice Malik has a background in law and international affairs. She completed her basic education in Paris, New York, and London, and later studied law at the Pakistan College of Law in Lahore. She has also served as an expert witness in England and Australia. As an attorney, she has authored a number of publications on judicial independence and Pakistan’s secular laws.
Justice Ayesha Malik will become the country’s first female Supreme Court judge. She was recommended for the appointment by the outgoing CJP, Mushir Alam, who will retire on August 17. A judicial committee is reviewing her nomination. She is currently serving on the Lahore High Court, where she is the fourth highest ranking justice. She earned her law degree from Pakistan College of Law, and was appointed to the Lahore High Court in March 2012.
Malik will join a male-dominated bench, making it difficult to gain a seat at the Supreme Court. The appointment of Justice Malik has been delayed since her nomination last September. There were also numerous protests and conflict over her nomination. However, her appointment was approved by the Judicial Commission of Pakistan on 6 January 2022, and she took her oath of office on 24 January.
